Qatari waqf Foundations between the Maqāṣid al-sharīʻah and principles of modern governance

Abstract

تتناول هذه الورقة التطور المؤسسي والقانوني للإدارة العامة للأوقاف في دولة قطر، وتؤطره في ميزان ركائز الحوكمة، من حيث الشفافية والنزاهة والمساءلة والمسؤولية والتمكين واللامركزية والامتثال للنظم والقوانين والتوازن والرقابة والفصل بين السلطات، تدرس وظيفة من أهم وظائفها وهي الولاية على الوقف من خلال قانون الوقف الجديد لعام 2021 وذلك في ضوء مقاصد الشريعة الإسلامية وكلّياتها. وتخلص الورقة إلى أنه لا بأس أن ينفتح الوقف على التطور الذي حدث بعد تأسيس الدولة الحديثة في كثير من الدول الإسلامية، ولكن مع مراعاة خصوصيته وإصلاحه من خلال اتباع مبادئ الحوكمة في النظم الإدارية الحديثة لتحقيق أكبر قدر من الرقابة عليه ومشاركة أصحاب المصلحة من مجتمع الواقفين وممثّليهم من النظار لدى وزارة الأوقاف وإدارتها المعنية بالوقف، ومع مراعاة هذه الخصوصية للوقف تتوطد الثقة مجددًا به وترجع مكانته وهيبته وحرمته وقدسيته.

This paper explores and analyses the institutional and legal development of the General Administration of Waqf in the State of Qatar in the context of governance, in terms of transparency, integrity, accountability, responsibility, empowerment, decentralization, compliance with regulations and laws, balance, oversight, and separation of powers. This paper also treats the concept of adminitration of waqf via Waqf act 2021 of the state of Qatar in light of Maqasid shari`ah. The findings of the paper show that it is permissible from shariah point of view for Waqf embrace the development that occurred after the establishment of the modern state in many Islamic countries, however, it is essential taking into consideration Waqf specificity and reform by following the principles of governance in modern administrative systems to achieve the greatest degree of control over it and the participation of stakeholders from the donors (Waqif) by the supervisors at the Ministry of Awqaf and its administration concerned with the Waqf, this paper believe that taking all these into consideration waqf will restore its trust, status, prestige, sanctity, and sanctity.
